These Terms of Service ("Terms") govern your use of the Stay Fed website at https://stayfed.au/ (the "Website") and your purchase or use of products and services offered through the Website.

The Website is operated by Anchor Age Trading Pty Ltd trading as Stay Fed ("Stay Fed", "we", "us" or "our").

By accessing the Website, creating an account, placing an order or otherwise using our Services, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use the Website or our Services.

1. Our Services

Stay Fed provides shelf-stable, ready-to-eat meals and related products through the Website.

Our products are intended to provide convenient food options that can be stored without refrigeration or freezing and prepared according to the instructions provided with the product.

Product descriptions, photographs, specifications, ingredients, nutritional information, preparation instructions and other information displayed on the Website are provided for general product information and may be updated from time to time.

We aim to ensure that information on the Website is accurate and current. However, minor variations may occur between product images, packaging and the product supplied.

2. Eligibility

You must be legally capable of entering into a binding contract to purchase products through the Website.

If you are under the age of majority in your jurisdiction, you should only use the Website with the involvement and permission of a parent or legal guardian.

Shipping and delivery charges may be additional and will be displayed during the checkout process where applicable.

We reserve the right to change prices at any time. A price change will not affect an order that we have already accepted, except where an obvious pricing error has occurred.

If a product is displayed at an obviously incorrect price due to an error, we may contact you before fulfilling the order. Where appropriate, you may choose to proceed at the correct price or receive a refund.

8. Orders

When you place an order through the Website, you are making an offer to purchase the selected products.

After placing an order, you may receive an order confirmation email. Receipt of an order confirmation does not necessarily mean that we have accepted the order.

We may accept or decline an order at our discretion where permitted by law, including where:

  • a product is unavailable;

  • there is an obvious pricing or product description error;

  • we reasonably suspect fraudulent or unlawful activity;

  • we are unable to verify the information provided; or

  • circumstances outside our reasonable control prevent fulfilment.

If we decline an order after payment has been made, we will arrange a refund of the amount paid for the affected order.

We do not ordinarily receive or store your complete payment card details where those details are processed by our payment providers.

We will arrange delivery using the shipping methods made available at checkout.

Delivery estimates provided on the Website are estimates only unless expressly stated otherwise.

Delivery times may be affected by circumstances outside our reasonable control, including courier delays, extreme weather, natural disasters, industrial action, transport disruptions or other events beyond our control.

You are responsible for providing an accurate and complete delivery address.

If an order cannot be delivered because the delivery information supplied by you is incorrect or incomplete, additional delivery charges may apply.

Risk in the products remains subject to applicable Australian law and does not transfer to you in a way that would unlawfully limit your consumer rights.

11. Returns, Refunds and Consumer Guarantees

We want you to be satisfied with your purchase.

Our products are subject to the consumer guarantees provided under the Australian Consumer Law (ACL).

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified.

Where a product has a major failure, you may be entitled to:

  • reject the product and obtain a refund;

  • reject the product and obtain a replacement; and/or

  • compensation for reasonably foreseeable loss or damage, where applicable.

For a failure that is not a major failure, we may be required to repair or replace the product within a reasonable time. If the problem cannot be remedied within a reasonable time, you may have further rights under the ACL.

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.

You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.

You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

These rights apply regardless of any additional returns or refund policy we may offer.

Change of Mind

Unless otherwise stated, we are not required to provide a refund or replacement simply because you have changed your mind, selected the wrong product or no longer want the product.

Any voluntary change-of-mind policy offered by Stay Fed is separate from, and does not limit, your rights under the ACL.

Because our products are food products, any voluntary return or change-of-mind policy may be subject to reasonable conditions concerning product safety, packaging, storage and whether the product can be resold.

12. Reporting a Problem With a Product

If you believe a product is defective, damaged, incorrectly supplied or otherwise does not meet the applicable consumer guarantees, please contact us as soon as reasonably practicable.

Please provide:

  • your order number;

  • the product name;

  • a description of the issue;

  • photographs where relevant;

  • the product batch or lot information where available; and

  • any other information reasonably required to investigate the issue.

We may request that you retain the product and packaging while we investigate.

We will assess the issue and provide an appropriate remedy in accordance with the ACL and any applicable voluntary returns policy.

13. Website Use

You agree to use the Website only for lawful purposes.

You must not:

  • use the Website in breach of any applicable law;

  • interfere with or disrupt the Website;

  • attempt to gain unauthorised access to our systems;

  • introduce malicious software, viruses or other harmful code;

We do not guarantee that reviews or other User Content represent the views of Stay Fed.

From time to time, we may offer promotions, discounts or promotional codes.

Unless otherwise stated:

  • promotional offers cannot be combined;

  • promotional codes must be entered before completing checkout;

Nothing in these Terms excludes liability that cannot lawfully be excluded, including liability arising under the Australian Consumer Law where applicable.

Where the law permits us to limit our liability, our liability will be limited to the extent permitted by law.

Nothing in these Terms is intended to exclude your rights to compensation for reasonably foreseeable loss or damage where those rights arise under the ACL.

21. Events Outside Our Control

We are not responsible for delay or failure to perform our obligations where the delay or failure results from circumstances beyond our reasonable control.

Such circumstances may include:

  • natural disasters;

  • severe weather;

  • fire;

  • flood;

  • epidemic or pandemic;

  • transport disruptions;

  • industrial disputes;

  • government restrictions;

  • telecommunications or internet failures;

  • power outages;

  • supply chain disruptions; or

  • other events beyond our reasonable control.

Where such an event occurs, we will take reasonable steps to minimise its effect and resume performance as soon as reasonably practicable.
